Terms of Service

These Terms of Service (“Terms”) govern your use of mashie, a web application for tracking informal golf bets (the “Service”). By creating an account or using the Service, you agree to these Terms.

The Service

mashie is a software-as-a-service subscription that helps recreational golfers track informal side bets played during a round of golf with their friends. The Service does not collect, hold, transfer, or process any wager funds. Players settle bets among themselves outside of mashie. We are a record-keeping tool, not a payment processor or gambling operator.

Eligibility

You must be at least 18 years old to create an account.

Your account

  • You're responsible for keeping your password secret and for any activity under your account.
  • Tell us promptly if you suspect unauthorized access at hello@mashieapp.com.
  • One person per account. Don't share credentials.

Subscription, trial, billing

  • mashie Pro is offered on an annual subscription. The current price is $17.99/year, displayed at checkout.
  • New subscribers get a 10-day free trial. We collect your payment method at signup and charge it once the trial ends, unless you cancel before then.
  • Your subscription auto-renews each year at the then-current price unless cancelled.
  • You may cancel anytime from your profile via Stripe's Billing Portal. On cancellation you keep Pro access through the end of the current billing period; we don't issue partial refunds.
  • Payment processing is handled by Stripe and subject to Stripe's terms. We receive payment status updates and a redacted card summary; we never store full card numbers.

Acceptable use

  • Don't use mashie to facilitate or organize illegal gambling. The Service is a personal record of friendly stakes; you and your friends are responsible for compliance with the laws where you live.
  • Don't try to break, reverse-engineer, scrape, or overwhelm the Service.
  • Don't impersonate other people or upload data about others without their consent (e.g., adding a friend with their email implies you have permission to do so).
  • Don't use the Service to harass, threaten, or harm anyone.

Your content

Rounds, scores, friends, and courses you create remain yours. You grant us a limited license to store and process them solely to operate the Service. We don't claim ownership and we won't show your data to anyone outside your account.

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. CALCULATIONS PERFORMED BY THE BETTING ENGINE ARE PROVIDED AS A CONVENIENCE; YOU ARE RESPONSIBLE FOR VERIFYING THE FINAL OUTCOME OF ANY WAGER WITH YOUR PLAYING PARTNERS.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MASHIE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $50, WHICHEVER IS GREATER.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that causes harm.

Changes

We may update these Terms. If the changes are material, we'll notify you by email or via the Service before they take effect. Continued use after the effective date means you accept the changes.

Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to conflicts of law principles. Disputes will be brought in the state or federal courts located in San Francisco County, California, and you consent to that jurisdiction.
